On the Motion of MALINDA SHELTON it is ordered that she be allowed fifty acres of vacant land in this county she having paid five cents per acre for the same and the Surveyor will execute and report a Survey thereon

December the 14th 1837 Survey for - MELINDA SHELTON fifty acres of land in Clinton County on the ridge between the waters of the Caney fork and Spring Creek, by Virtue of an order of the County Court of said County of their March Term 1837 Betinning at a Sugartree where a stake [at] PROVINCE'S Corner shoudl stand, thence with his line S67 W61 poles to a Beech and Maple his Corner, thence South 11 poles to a Chestnut Oak, thence S45 E34 poles to a Maple and Beech, thence S12 W20 poles to a Black Oak and Hicory on DALTON'S line, thence with it S58 E40 poles to a stake near the Corner of his fence - thence S85 E12 poles to a stake, North of C.T. DALTON'S House, thence S40 E30 poles to a Sugartree, thence S78 E30 poles to a Black Oak, thence North 20 poles to a Hicory on BURKS line, thence with it N37 W23 poles to a chestnut his corner, thence with his line S55 W30 poles to a Stake & ponters his corner, thence with his line N45 W35 poles to a Sugartree his Corner, thence N8 E60 poles to a poplar and -- Buck Eye, thence N77 E20 poles to a Sugartree and pointers, thence N30 E28 poles to a Sugartree, thence N38 W105 poles to a Maple and pointers, thence N80 W50 poles to a large dead white oak -- and Pointers PROVINCE'S Beginning Corner, thence with his line S35 E131 poles to the Beginning.

[Transcriber's Note - C.C. = Chain Carrier, HKr = Housekeeper - directed the survey, S.C.C. may have meant Senior Chain Carrier, or Senior Clerk of Court?] The original Survey was folded in thirds, with the following inscriptions on the center fold: "Melinda Shelton - 05 Acres plat. CHARLES A. WICKLIFFE, ESQ, Lieu. & Acting. Governor of the Commonwealth of Kentucky, to all to whom these Presents shall come, Greetings, Ynow {sic} Ye That by virtue and in consideration of an order from the Clinton County court, there is granted by the said Commonwealth, unto MELINDA SHELTON a certain Tract or Parcel Of Land and containing fifty Acres, by survey, bearing date the 14th day of December one thousand eight hundred and thirty nine lying in the county of Clinton on the Ridge between the waters of the Caney fork and Spring Creek. Beginning at a Sugartree where a stake [at] PROVINCE'S Corner Shoudl stand, thence with his line S67 - W61 poles to a beech and maple his corner thence S11 poles to a Chestnut oak thence S45 E34 poles to a maple and beech thence S12 W20 poles to a black oak and hickory on DALTON'S line thence with it S58 E40 poles to a Stake near the corner of his fence thence S85 E12 poles to a Stake North of E.T. Daltons {sic. - should be C.T. MIDKIFFE, ESQ., Lieu. & Acting Governor of the Commonwealth of Kentucky, hath hereunto set his hand and caused the seal of the Commonwealth of Kentucky to be affixed, at Frankfurt, on the 2nd day of June in the year of our Lord one thousand eight hundred and forty and of the Commonwealth, the forty ninth.

NOTES: MELINDA SHELTON is a mystery. She never appeared by name on any census in Kentucky or Tennessee. She probably was the extra female, age 40 to 50 (born about 1790 to 1800), in the household of Isaac Shelton on the 1840 Clinton Co., KY Census. In 1846 land was surveyed next to Melinda’s property for Michael Brown. In 1850 Isaac Shelton was still living next to Michael Brown, but Melinda was not present. The inference is that Melinda Shelton was an older sister or the mother of Isaac Shelton, and that she died by 1850, If she was his mother she may have been older than shown on that census. No proof. Since the Clinton Co., KY courthouse burned in 1865 there is no record of what happened to Melinda or her property.

1860 Wayne Co., Kentucky -- Isaac's widow was living in Monticello with daughter, Salina. Where did the land go?

In 1836 Clinton Co., KY was carved from the counties of Cumberland and Wayne. In 1830 there were two heads of household in Cumberland Co., KY who may have been the PROVINCE named in this Survey. They were HIRAM PROVENCE and THOMAS PROVINCE.

In 1840 THOMAS BURKE lived between JOHN SHELTON and ISAAC SHELTON.
