Will
of Joshua Wallace
"Know
all men by those present that I Joshua Wallace considering my old age and the
uncertainty of life, do make this my last will and testament.
I bequeath my wife Elizabeth one third of my farm including all on this
side of the creek two horses and all my farming utintiales, on the farm, three
cows, one third of my sheep, on third of my hogs, and all of my household and
kitchen furniture during her natural life of widowhood.
My son John considering what I have given him heretofore, I give him two
hundred acres it being a part of a tract of land owned by me containing five
hundred joining Ebenezer Wallace valued at one dollar per acre and to be charged
to his account at the titlement of the estate.
My son Ebenezer considering what I have given to him heretofore, I now
give to him thirty acres of land it being a part of the tract of land given to
John, valued at one dollar per acre to be accounted for as above.
My daughter Elizabeth Clements Considering what I have given her
heretofore and holding two notes against Clements estate I wish her to be
charged with their amount on the
day of titlement but without interest. Miriam Wallace wife of my son Benjamin if she will give me
the lot now known as the Ridgeway lot, I will make her a deed to the tavern lot
and if not she must be disposesed of the tavern lot. My son Joseph he has a bill of sale of my three Blacks,
-----John, Ann and Mandy for his part of my estate. Now for my sons Samuel, George, Robert, and my daughter
Rachel, I wish them to share all equally in my property on the general titlement
of my estate. It is my will further
that neither my children by my former wife nor my present wifes children by her
former husband shall live or reside on the place with my present wife.

"Memorandum
- That on this 26th day of October in the year 1839, Benjamin Wallace of the
County Henry being sick of the sickness whereof he died on the 26th day of the
same month at his dwelling house in the said county did make and declare his
last will and testament nuncusative in these or words of like substance that is
to say: I give and bequeath unto my
wife Mirian all my real and personal e3state after my debts have been paid.
These words or the like effect the said Benjamin Wallace declared in the
presence of the subscribers with the intention that the same should his last
will and testament. Whereof he desired them to bear testimony which we reduced to
writing this 29th day of October in the year 1839. Lockport Oct. 1839."
