On November 4 of the year 1833 in Henry County in the state of Kentucky, the said pensioner at the age of 81 appeared in open court and stated and swore that he had volunteered to serve on June 1 of the year 1776 in the Virginia Militia in Micklinburg County in the state of Virginia in the company under the command of Captain John Ballard.  He stated that he had joined the troops at Hamptontown in the state of Virginia under the command of Colonel Buffin and Colonel Meredith.  He stated that they had then marched to Portsmouth on the James River and they remained there until December 22 of the year 1776 and he was then honorably discharged by his Captain.

Then again the second week of the month of February of the year 1779 he entered the service in the company under the command of Captain Reuben Vaughn and in the regiment under the command of Colonel Licheril and he then joined his company at Micklinburg Court House in the state of North Carolina where they remained for a period of five or six weeks and they then marched to Stono on the St. James River and in the state of North Carolina and there he then joined a company of light infantry under the command of captain Edmonds and in the regiment under the command of Colonel Henderson.  They were then in a skirmish with the British on June 20 of the year 1779 and the said pensioner was honorably discharged on August 12 of the year 1779 at Stono by his Colonel.

He then again entered the service in the month of February of the year 1781 to serve in the company under the command of Captain Marshall and they then marched to Taylor's Ferry on the Deep River in the regiment under the command of Colonel Deadman.  He entered the service again in the month of September of the year 1781 to serve in the company under the command of captain John Brigg for a tour of six weeks duration and he was then honorably discharged in the month of October of the year 1781.

The said pensioner stated that he was born on July 25 of the year 1752 in Brunswick County in the state of Virginia and he said that after the termination of the War of the Revolution he had removed to Mercer County in the state of Kentucky and then he had removed to Garrard County in the state of Kentucky and then four years ago he removed to Henry County in the state of Kentucky and part of that four years he had been residing in Jefferson County in the state of Kentucky.

The affidavit of William Ladd and Elias McDaniel was also given at the same time and in the same place as the foregoing, the said deponents stated and swore that at one time and in the said county they had both been well and favorably acquainted with the said pensioner and they also stated and swore that in the neighborhood in which the said pensioner resided he was reputed to have served in the War of the Revolution on the side of the United States of America. 

The said pensioner himself, James Pennington, was on the Kentucky Roll of Pensions at the rate of $44.77 per annum and his certificate of pension for that amount was issued on December 14 of the year 1833 and it was then sent to the Honorable F. H. Ope. H. R.
