On October 30 of the year 1817 in Louisville in the state of Kentucky the said pensioner appeared in open court for the purpose of appointing the Honorable Richard C. Anderson to act in the capacity of his attorney.  The said pensioner also stated and swore that he had received a sword wound during the Battle of New Orleans on January 8 of the year 1815.

On October 8 of the year 1816 in Louisville in the state of Kentucky the affidavit of Craven T. Luckett was also given.  The said deponent stated and swore that the said pensioner was a shoemaker by trade and that he resided in Galipolis and that he had served in the capacity of a Militia Man in the company under the command of Captain Thomas Joyce, and Major General Thomas and this deponent also stated and swore that the said pensioner was wounded on the Mississippi River.

Section 83

The affidavit of Thomas Joyce was also given at the same time and in the same place as the foregoing.  The said deponent stated and swore that the said pensioner was a resident of Galipolis and that he was a shoemaker by trade and that he had served in the company under his, the said deponent's command, and that the said pensioner had been wounded while in the said service.

On September 24 of the year 1817 in Louisville in the state of Kentucky, the affidavit of John M. Talbot, a practicing physician was also given.  The said deponent stated and swore that the said pensioner had a want of strength and also a lock of motion due to the wound received while in the service of the United States of America.

On March 12 of the year 1840, the affidavit of J. J. Collins, also a practicing physician was also given.  The said deponent stated and swore that he had been a surgeon of the United States Army and he stated and swore that the pensioner deserved $4.00 more pension that he was receiving and he also swore that he was disabled by the wound received in service.  He stated that the said pensioner had been a private soldier in the Thirteenth Regiment of the Kentucky Detached Militia and that he had received a wound on January 8 of the year 1815 while taking part in the Battle of New Orleans in the State of Louisiana.

Section 84

On April 3 of the year 1815, the affidavit of John Davis was also given.  the said deponent stated and swore that he was or had been a Lieutenant Colonel of the Thirteenth Regiment of Kentucky Detached Militia and he swore that the said pensioner had served and had enlisted as he had stated and also that  he had been wounded as had been stated in open court.

The affidavits of John Thomas and George H. Hill was also given at the same time and in the same place as the foregoing.  The said deponent stated and swore that the said pensioner had served and had been wounded as he had stated aforesaid in open court.

On February 2 of the year 1838 in Hamilton County in the State of Ohio, the said pensioner again appeared  in open court and stated that he wanted his pension payable in future at the above place.  He stated that he had removed as aforesaid in order to better his situation and in order to reside with his children.

The affidavit of Charles H. Cooper was also given at the same time and in the same place as the foregoing.  the said deponent stated and swore that the said pensioner, James Stewart, was the identical person that he claimed himself to be.

In the month of October of the year 1817 in Louisville in the State of Kentucky, the affidavit of John Creghan, M. D. was also given.  The said deponent stated and swore that he was a practicing physician and he also swore that the said pensioner had been wounded in his left shoulder during the Siege of New Orleans.

Section 85

On January 18 of the year 1817 in Gallia County in the State of Ohio, the affidavit of Jonas Laffon, M. D., and Jacob Kithridge, M. D., was also given.  The said deponents stated and swore that the said pensioner had been wounded as aforesaid and that he was incapable as a result of the said wound.

On January 18 of the year 1817 in Galiopolis in Gallia County in the State of Ohio, the said pensioner again appeared in open court for the purpose of appointing the Honorable William Creighton and the Honorable Ormsby to act as his attorneys. 

It was also stated in open court that the said pensioner, James Stewart, had married on March 3 of the year 1816 Polly Phillips by the Reverend Mr. Gould and it was also stated that the said pensioner had died on September 22 of the year 1842.

Section 86

On October 16 of the year 1878 in Hamilton County in the State of Ohio, the affidavit of Mrs. Mary Grabley was also given.  The said deponent stated and swore that she was at the age of 45 years and she swore that she was the daughter of James Stewart.  She also stated and swore that she had been present at the funeral of her father, the said pensioner, James Stewart, and she swore and stated that he died on September 22 of the year 1842 at Cincinnati in the State of Ohio.

On July 24 of the year 1878 in Hamilton County in the State of Ohio, the affidavit of Josiah Bunnell and Samuel Runk? was also given.  The said deponents stated and swore that they had been both well and favorably acquainted with the said Polly Stewart, the widow of the pensioner, in the said county and state from the year 1842 and they also stated and swore that the said Polly Stewart still remained the widow and relic of the said pensioner, James Stewart, as aforesaid.

On October 15 of the year 1878 in Hamilton County in the State of Ohio, the affidavit of Mrs. Elizabeth Jones? Jonte was also given.  The said deponent stated and swore that she was at the age of 49 years and she swore that she was a daughter of the said pensioner, James Stewart, and she also swore that she was present at the funeral of her father, the said pensioner and that she had resided near him at the time of his death on September 22 of the year 1842 in Cincinnati in the State of Ohio.

Polly Stewart, the widow of the pensioner, was on the Columbus Agency of Pensions at the rate of $8.00 per month to commence on March 9 of the year 1878 and her certificate of pension for that amount was issued on November 16 of the year 1878 and it was then sent to her pension agent.
