On May 16 of the year 1818 in Jefferson County in the state of Kentucky, the said pensioner appeared in open court and stated that he had enlisted in the Spring of the year 1777 to serve for a tour of three years duration in the company under the command of Captain Dudley in the Second Virginia Regiment of the Virginia State Line.

Section 142

He was in the regiment under the command of Colonel Smith and also under the command of Lieutenant Colonel Brent.  He stated that he had served in the Battle of Stoney Point and also in the Battle of Monmouth and he stated that he was honorably discharged at Fredericksburg in the state of Virginia by the aforesaid lieutenant Colonel Brent at the end of three years of service.

The affidavit of William White was also given at the same time and in the same place as the foregoing.  The said deponent stated and swore that he had been born and raised in the same neighborhood in King George County in the state of Virginia with the said pensioner and this deponent also stated that in the neighborhood in which the said pensioner resided he was reputed to have enlisted in the War of the Revolution.  This deponent also swore that his brother, John White, stated that he had served with the said pensioner and that the pensioner was a fine soldier.

On June 12 of the year 1821 in Jefferson County in the state of Kentucky, the said pensioner at the age of 67 years again appeared in open court and stated that he had enlisted in Caroline County in the state of Virginia in the Spring of the year 1776 or 1777 to serve in the company under the command of Captain Ambrose Dudley for a tour of three years and he also stated and swore that they had rendezvoused at Williamsburg and that there he came under the command of Captain Harry Dudley and they then marched north in the regiment under the command of Colonel Gregory Smith and he also came under the command of Colonel John Gibson and in his regiment in the Fourteenth Regiment.

Section 143

The said pensioner also stated that he had served at the Battle of Monmouth and also at the Battle of Stoney Point.  He stated that he was honorably discharged at Fredericksburg in the state of Virginia by the aforesaid Colonel Brent after having served for a tour of three years.  The said person also stated that he had a wife at the age of forty-five years and three children:  Annie, Betsey and John, the eldest of whom was at the age of 5 years.  He also stated that he himself was a farmer by occupation.

On September 8 of the year 1851 in Marion County in the state of Indiana, Eva Wilkerson, being at the age of 87 years and being the widow and relic of the said pensioner, appeared in open court and stated that they had been married on September 24 of the year 1792 and that her husband had died on Mar 1(sic) of the year 1840 and she stated that she still remained his widow and relic.  At the same time the said widow appointed John M. Jewell of Washington in the District of Columbia to be her lawful attorney.

Section 144

On October 2 of the year 1851 in Jefferson County in the state of Kentucky, the affidavit of Curran Pope was also given.  The said deponent, being the Clerk of the Jefferson County Clerk, produced the following:  "I do hereby certify that I married the within named Benjamin Wilkerson and Eva Russell on the twenty fourth day of September of the year 1792, Samuel Reaver, M. Gospel.  State of Jefferson County."

It was also discovered in the same group of documents that on September 23 of the year 1792, Henry B. Cole, the then clerk of the Jefferson County Court, had authorized the marriage of the said pensioner and his wife.

In a letter dated on April 17 of the year 1818 from Fayette County in the state of Virginia, Captain Ambrose Dudley stated and wrote that he pensioner above named had indeed enlisted to serve in the company under his, the writer's command during the War  of the Revolution.

On September 12 of the year 1851 in Jefferson County in the state of Kentucky, the affidavit of Pleasant Baley and Mrs. Jane Baley was also given.  The said deponent stated and swore that they had been present at the marriage of the said pensioner and they also swore that he and his wife had lived together as man and wife and that he had died as his widow had stated before in her declaration.

Section 145

On September 11 of the year 1851 in Jefferson County in the state of Kentucky, the affidavit of Nathan Mardis was also given.  The said deponent stated and swore that he had been both well and favorably acquainted with both the said pensioner and his widow before the death of the said pensioner.  This deponent also stated and swore that the said pensioner and his widow had resided together as man and wife and that the said pensioner had died as had been stated.

On Aug 21 of the year 1855 in Marion County in the state of Indiana, Eva Wilkerson, being at the age of 76 years and being the relic and widow and so forth of the said pensioner, again appeared in open court and stated they had been married in Jefferson County in the state of Kentucky on February 12 of the year 1815 by David L. Ward, a minister of the gospel and she also stated that her maiden name had been Eva Brock.  She made this declaration for the purpose of applying for the bounty land that was due her because of her husband's services.

The affidavit of Joseph McConnell and Thomas Whiteside was also given at the same time and in the same place as the foregoing.  The said deponent stated and swore that the above declaration was made and signed in their presence and they also stated and swore that the said Eva Wilkerson was the identical person that she claimed herself to be.

On September 11 of the year 1855 in Jefferson County in the state of Kentucky, the affidavit of Ch. H. Thenston was also given.  The said deponent, being the Clerk of the Jefferson County Court, stated and swore that the said pensioner had been married by his records and properly so.

Section 146

Eva Wilkerson, the widow of the pensioner, was on the Roll of Pensions at the rate of $80.00 per annum and her certificate of pension for that amount was issued on December20 of the year 1851 and it was then sent to J. M. Jewell, Esquire.  The said widow Eva Wilkerson was also on the Roll of Pensions at the rate of $96.00 per annum and her certificate of pension for that amount was issued on December 20 of the year 1851 and it was sent to J. M. Jewell, Esquire.

The said pensioner himself, Benjamin Wilkerson, was on the Kentucky Roll of Pensions at the rate of $8.00 per month to commence on May 16 of the year 1818 and his certificate of pension for that amount was issued on May 23 of the year 1822 and it was then sent to R. C. Anderson, Junior, Esquire at Louisville in the state of Kentucky.
