In the name of God Amen

I Jacob Anthony of the county of Muhlenberg and Commonwealth of Kentucky, being in good health and in my mind, but believing that all must die and that while in health is the best time to so arrange my worldly concerns that little trouble may arise in settling my business upon death, I therefore make this my last will and testament.

In the first place, my will is that all my just debts & funeral expenses be paid.

Secondly, I give and bequeath to my sister Polly Rust, my two negro women, namely, Bet and Charity, and all their children & increase, during her life, and at her death to be divided among my said sister's children, towit, John J. Rust, James H. Rust & Jane Ward, the wife of Charles D. Ward, so as to make them equal, to them and their heirs forever.

3dly, I give and bequeath to my nephew, Thomas J. Anthony and his three sisters, namely, Polly Cobb, Rosanna Jenkins, wife of Robert Jenkins, & Emeline Harrison, wife of Solomon Harrison, my negro woman Nancy and all her children, to be equally divided among them, to them & their heirs forever.

4thly, my will is that three of my slaves, towit, Winney, Celia, & George be free at my death, that they enjoy all the freedom that any persons of color can enjoy under the law of this state or the United States, and furthermore, I give and bequeath to Winney one hundred dollars and to Celia & George fifty dollars each to be paid to them by my executor.

5thly, my will and desire is that all the remainder of my estate be sold and the proceeds thereof equally divided between the children of my brothers William Anthony and John Anthony, or such of their children that should be living at my death, to them and their heirs forever.

I now consitute and appoint my friend & neighbor Ephraim M. Brank Esqur. executor of this my will & testament.

I do hereby revoke and make void all other wills by me made and declare this and no other to be my last will and testament.

In testimony whereof I have hereutno set my hand & seal this 5th day of October in the year A.D. 1838.

The foregoing last will & testament of Jacob Anthony, deceased, was exhibited into court & proved to be the act & deed of the said Anthony by the oaths of Charles F. Wing and William H.C. Wing, subscribing witnesses thereto, which is thereupon ordered to be recorded.
