Transcription

I, Wm. P. Barbee, of the county of Muhlenberg & state of Kentucky, being weak in body but sound in mind, do hereby make this my last will and testament and hereby revoke all former wills made by me.

First, I will and bequeath that all my just debts and funeral expenses be first paid.

Secondly, I give and bequeath unto any child or children that has been born or may hereafter be born within ten months from the 27th day of July 1874 of Sarah Ann Dyson, my last wife, but from whom I am now divorced, the sum of ten dollars to said child or to each of said children, provided more than one is born of said Sarah Ann Dyson within ten months from and after July 27th, 1874, said sum or sums to be paid by my execuotr hereinafter named out of the proceeds of my estate.

Thirdly, After providing for the above bequest, I give, will, and bequeath the reminader of my property both real, personal, and mixed, money, choses in action, in fact every thing that I may own at my death unto to my three following named children, towit. Green Edward Barbee, Robert Willson Barbee and Hezekiah Rowland Barbee, to be divided equally between the said three.

I hereby nominate and appoint my friend J.F.M. Brown as my executor of this my last will and testament and hereby direct and request that he have full power and control over my whole estate with full power to sell any and all of my property both real, personal and mixed at such terms and upon such terms as he the said Brown may think best.

I hereby nominate and appoint my friend M.C. Hay as guardian for my three above named children towit: Green Edward Barbee, Robt. Willson Barbee & Hezekiah Rowland Barbee, during their minority and desire that he haveth care & control of said children & provide their nurtures, education & of the selecting of suitable homes for them & for each of them during their minority.

In testimony whereof I have hereunto subscribed my name this the 12th day of May 1875.

The foregoing last will and testament of W.P. Barbee decd. was produced to court and proved to be the act and deed of the said W.P. Barbee decd. by the oaths of G.L. Metzker and Mollie Metzker, the two subscribing witnesses thereto, and the same is ordered to record which is now done accordingly.
