In the name of God amen

I Martin W. Boggess of the county of Muhlenberg & state of Kentucky being feeble in body but of sound mind & disposing memory calling to mind the uncertainty of life & the certainty of death and wishing to dispose of what estate God has been pleased to bless me with, so as to give my legal heirs & representatives littl inconvenience after my decease do make utter & publish this my last will & testament in the manner following.

Item 1st It is my will & desire that after my deceased my funeral expenses & just debts be paid.

Item 2nd It is my will & desire that my wife Martha E. Boggess have the homestead tract of land entirely to her use & enjoyment during her widowhood the tract containing by survey one hundred ten acres. After she ceases to be my widow either by death or marriage thence to be sold & the proceeds equally divided between her legal heirs & representatives also what personal property as is exempt by law exemption to housekeeper.

Item 3rd I give & bequeath to my son William Henry Boggess five dollars to be paid out of my personal estate which shall constitute his entire interest in my estate.

Item 4th I give & bequeath to my son James Marion Boggess the remaining fifty acres of my tract of land or what remains after taking off the one hundred & ten acres as above specified which is to constitue his enter interest in my estate the meets & bounds of the fifty acres hereby bequeathed to James Marion Boggess are as follows towit: Beginning at my beginning corner a [?] & red oak thence running south with the east line to the south east corner of his enclosed field, thence west to the cross fence thence north with his sd. cross fence to the hanging rock thence with the running west to include the number of acres to the north line thence to the beginning.

In testimony whererof I have hereunto set my hand and affixed my seal this the 6 day of June 1881.

The foregoing last will and testament of Martin W. Boggess decd. was this day produced to court and proven to be the act and deed of the said Martin W. Boggess Decd. by the oaths of James M. Drake and T. P. Allen the two subscribing witnesses thereto whereupon the same was ordered to be recorded which is now accordingly done.

I Martha Elizabeth Boggess, widow and relect of Martin W. Boggess decd., whose last will and testament was this day probated in the Muhlenberg County Court do hereby renounce the provisions of said last will and testament and elect to take such interest and right in and to his estate real and personal as I am entitled to under the statute of descent[?] and distritubtion. Witness my hand this 31 day of October 1881.

Boggess was thsi day produced to me in my county and proven to be the act and deed of Martha E. Boggess by the oaths of Charles Eaves and W. H. Yost the two subscribing witnesses thereto whereupon said instrument of writing together with this certificate is admitted to and truly recorded in my office. Witness my hand this 31 day of October 1881
