Adlai Boyd, 1882

Know all men by these present that I Adlai Boyd of the county of Henderson state of Kentucky, being in good health and sound and disposing mind and memory do make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore by me made.

And as to my worldly estate and all the property, real, personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease, I devise, bequeath and dispose thereof in the manner following towit,

All my household and kitchen furniture to my wife Almira J.M. Boyd, two surveys of land lying in Muhlenberg County, Kentucky. They are deeded to her and her present heirs by me, equally towit, 250 acres lying on the waters of Wards run or Pond Creek woodland also 175 acres more or less in the same county being my old farm on the waters of Cypress Creek. Also 100 acres, also 25 acres on the waters of Cypress Creek same county and state. The title of the two last named tract of 125 acres is in Mrs. Mary E. Reynolds of Greenville, Muhlenberg County, Ky., my daughter by my first wife, I holding her written obligation to deed these two tracts of 125 acres to whoever I may direct. I herein direct her to deed the 125 acres to Almyra J.M. Boyd, my present wife, after the 125 acres shall have been deeded to Almira J.M. Boyd by my daughter Mary E. Reynolds and when it appears to her Almira J.M. Boyd best judgment and after she shall have consulted Robert C. Grundy's as to the best time and terms as her counselor to sell and convey the above two tracts of land amounting to 125 acres and the entire proceeds of the sale of the 125 acres to be equally divided between her Almira J.M. Boyd and her children by me and all the children by my first wife.

I have in the town of Hebardsville, Henderson County, Ky., two separate houses and lots, one I and family are living in, the other rented to and occupied by Peter Dixon. In event of my death during my anticipated trip this month to the state of Texas as a delegate to the General Assembly, I wish her to sell after counseling and addressing my friend Dr. N.L. Lightfoot as to the best course and terms of sale the two above named houses and lots and to deed the purchaser the same, the proceeds of the sales of the above named lots is to be equally divided between Almira J.M. Boyd and her children by me where above it says deed to means to Almira J.M. Boyd.

I have some notes and accounts something over one thousand dollars in all of which I wish equally divided between my present wife Almira J.M. Boyd and her children by me. Also I have one mare and sucking colt and one two year old colt and two cows and calves all of which I wish her to sell and divided the proceeds equally between herself and my children by her but if she thinks best she may instead of dividing the procees of the sale of stock she may purchase other stock for her and the children to me on the farm which I wish her and the children to move to. I mean my old farm in Muhlenberg County, Ky.

Whereunto I said Adlai Boyd have this day subscribed my name and affixed my seal in the presence of Dr. N.L. Lightfoot, Robert Heart & James H. Burns all of Hebardsville, Henderson County, state of Kentucky.

State of Kentucky, Henderson County } February County Court 1882. Sct. (27th Feby 1882)

This day this paper purporting to be the last will and testament of Adlai Boyd late of Henderson County Ky. deceased was produced in open court and on the 27th Feby. 1882 was proved according to law by the oaths of Dr. N.L. Lightfoot and on the 1st March 1882 the same was proved by the oath of J.H. Burns according to law two of the subscribing witnesses thereto. Thereupon the same was adjudged to be the true last will and testament of the said Adlai Boyd decd. and ordered to be recorded which is here done.
