Transcription

February the 5, 1844

I now being old and weak & low situation & having full possession of my reasoning powers, I do hereby make my last will & testament.

in the first place, I bequeath my son John the tract of land that he is now living on.

I bequeath my beloved wife Jane the tract or parcel of land that I now reside upon to have during her existence with as much household & kitchen furniture as she needs for her use & support & after her decease, it is my will that my youngest son Josiah shall have the last mentioned tract of land.

It is my wish & will after further consideration that for the better support & comfort of my wife that she shall have the farming implements and one horse (towit) the gray mare Phoenix.

It is my will likewise that the young woman that we have raised Rachel Rickard shall at the decease of my wife have on e bed & furniture for the bed & one cow & calf or if she Rachel gets married, I wish her to have the above mentioned property at the time of her marriage.

I bequeath the remainder of my estate to my son James & to my three daughters Nancy Stringer, Elizabeth Kittinger & Cynthia Moore & my grandson Joseph Edmund Estes to be divided equally between them & what property myu wife may have at her decease I wish to have divided equally between [the] last mentioned five heirs with the exclusion of my oldest son John & my youngest son Josiah. I appoint my son Josiah my executor.

The foregoing last will & testament of Charles Ellis, deceased, was exhibited into court by the executor therein named & proved to be the act & deed of the said decedent by the oath of David S. Baker, a subscribing witness thereto, & ordered to be certified and at the June term of said court 1844, the said will was fully proved by the oath of Isaac Mize, the other subscribing witness thereto, & ordered to be recorded.
