Transcription
In the name of God amen. I Thomas Irvin Sr. of the county of Muhlenberg and state of Kentucky being weak in body but of sound mind and memory and calling to recollection that it is appointed for all mankind once to die, do think proper to make this my last will and testament.
Item the first, it is my will and desire that my just debts be paid and satisfied by my executors to be hereinafter named.
Item the second, I give, grant and bequeath to my beloved wife Jane Irvin one horse, two cows, one bed and furniture, and four head of sheep and she the said Jane is to have her support on and from the plantation on which I now live and my negro man Harry is to work for her and my daughter Polly Ann & Rebecca during her the said Jane's lifetime until they or either of them should before that time think proper to marry.
Item three, it is my will and desire that the 200 hundred acres survey of land lying in this county which I purchased of Townsend Duncan be equally divided between my daughter Polly Ann and the children of Robert and Nancy Clark and Rebecca Irvin and that Polly Irvin's part thereof be laid off adjoining the 40 acres track of land in her name and I further give, grant and bequeath to said Polly Ann & Rebecca Irvin one horse creature and one cow each together with one bed & furniture each, to the three last mentioned persons and a bed & its furniture to Lucinda Irvin & it is clearly to be understood that the children of Mr. & Mrs. Clark are to get one fourth of said land as mentioned on this item as the part of my daughter Nancy Clark.
Item the fourth, it is my last will that the tract of land in my name on Pond River in this county be equally divided between James Irvin and John Morgan so taht James Irvin have his improvement thereon.
Item the fifth, at the decease of my wife Jane Irvin provided that my negro man Harry should survive her, it is my desire that he be hired out to some of my heirs annually if it should so suit if not here to others and his wages divded amongst my children equally.
Item the sixth, I bequeath to Polly Irvin the 40 acre tract of land lying in this county taken up, surveyed & patented in her name to her & her heirs forever.
Item seventh, I give and bequeath to John Garven & Elizabeth his wife the tract of land entered in the name of James McCartney in the county on Pond River to them & there heirs forever.
Item eighth, I give, grant and bequeath to Thomas Irvin Jr. the 200 acre survey on which I now live and likewise one bed & furniture to be his forever.
Item the ninth, I give, devise and bequeath to the children of George & Peggy Young four head of [unreadable, possibly crossed out] cattle.
Lastly I do hereby appoint James Irvin and Thomas Irvin Jr. executors to this my last will and testament hereby ratifying & confirming this & no other to be my last will and testament. In testimony whereof I have hereunto set my hand and affixed my seal this 12 day of September in the year of our Lord one thousand eight hundred and twenty three.

The foregoing will of Thomas Irvin Sr. was produced in court and proven by the oaths of John Ferguson & James Tinsley, subscribing witnesses thereo, & ordered to be recorded.
