Transcription

In the name of God, Amen, I Dicy Newton of the county of Muhlenberg and state of Kentucky being sick and weak in body but of sound mind and disposing memory do make this my last will and testament hereby revoking all former wills by me made and declaring this to be my last one.

1st I desire that all the personal part of my estate be immediately sold after my decease and out of the moneys arising therefrom all my just debts and funeral expenses be paid and should the perishable part of my estate prove insufficient for the purposes as above mentioned, then I desire my Executors hereinafter named to collect from Mr. James Taggart five hundred and ten dollars the balance of the sum of money I placed in his hands to keep for me in the year 1845 or 4 with legal interest thereon and out of the money arising therefrom pay and satisfy such of my just debts as shall remain unpaid out of the perishable part of my estate.

2nd after the payment of my debts and funeral expenses I give to my son Hilary Newton and his heirs forever the balance of the sum due me from said Taggart, also all that is due me from the estate of my husband Abraham Newton decd. Also, all the rest of my estate of what nature or kind it may be not herein before particular named except one dollar hereinafter mentioned.

3rd I give to my son John Newton one dollar if he be living. And lastly I do hereby constitute and appoint my friends Alexander Mcpherson and Samuel Turner Executors of this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this 14” day of March one thousand eight hundred and fifty.

The foregoing last will and testament of Dicy Newton deceased was produced into court and proven to be the act and deed of the said Dicy Newton by the oath of W.H. Whitaker and James S. Turner, the subscribing witnesses therein named & is ordered to be recorded which is thereupon admitted to & truly recorded.
