Upton S. Nofsinger, 1892

June 28th 1892

In the name of God Amen

I Upton S. Nofsinger of Muhlenberg County Ky. being of sound mind and disposing memory do make this as my Will and Testament, revoking all former Wills made by me.

1st I will my Soul to God who gave it.

2d John W. Nofsinger I have given Five Hundred dollars which his full share of my estate and I give him nothing more.

3d I have given Tabith Drake One Hundred dollars, she having received this amount from me. I give her nothing more out of my estate.

4th I have given Martha E. Rose over Two hundred dollars which she has received. I give her nothing more out of my estate.

5th I have given Sallie E. Richardson one hundred dollars, she has received that amount. I give her Nothing out of My estate.

6th Milton Nofsinger, I have give him Two hundred dollars in Stock and Farming Tools. I further give him a tract of land on waters of Nelson Creek, Known as the Fogle place adjoining Clint Clarr.

7th I have given Elizabeth Heltsley one Hundred dollars, which she has received. I therefore give her nothing more out of my estate.

8th I now give William H. Nofsinger and Edward A. Nofsinger the farm I live on about Three hundred and Seven acres more or less which has been divided between them as follows, the division line is Beginning at a white oak on a branch, one of the old corners, running due North 54 poles to a rock, thence North 25 W 20 poles to a Beech at the fence, thence North 18 W 39 poles to a rock in the lane, thence with the lane N 50 E 22 poles to a rock in the lane, thence N 31 W 132 poles to a hickory in the old line on a hill or Tyler line; I also give to William H. Nofsinger and Edward A. Nofsinger all my house hold and Kitchen furniture with every description of property I own at my death, Cash, Cash notes, accounts or any other articles or articles not named for these two Sons.

William H. Nofsinger is to have west side of the land where I reside and Edward A. Nofsinger is to have the east side of said land. Edward A. Nofsinger is to exercise the right of cutting and using timber off of William H. Nofsingers land to keep his part of the farm repaired as long as there is any timber required.

The foregoing last Will and testament of Upton S. Nofsinger deceased, was produced to Court on the date aforesaid, and proved to be the act and deed of said decedent, by the oaths of J.H. Reno and J.W. Sharp, the subscribing witnesses thereto, Whereupon the same was ordered to be recorded which is now done accordingly
