Austin Oliver Will

Transcription

In the name of God, Amen. I Austin Oliver of the county of Muhlenberg and state of Kentucky being of sound mind and disposing memory do make and ordain this my last will and testament.

Item 1st It is my will and desire that all of my just debts and burial expenses shall be paid.

Item 2nd I desire that my beloved wife Kitty shall have one third of my landed estate during her natural life.

Item 3rd It is my will and desire that the portion of real estate devised to my wife Kitty shall be at her death divided equally between my daughters Frances and Alice and my son William.

Item 4th it is my will and desire that my sons George and James by my former wife Matilda shall have the sum of One Hundred Dollars each after the settlement of all claims against my estate.

Item 5th It is my will and desire that Emily Culverson, daughter of my wife Kitty by her former husband shall have the sum of Fifty Dollars paid to her out of my Estate.

Item 6th It is my will and desire that the remainder of my Estate be equally divided btween my son William and daughters Frances and Alice, my children by my present wife Kitty and Peter Fulkerson, son of my wife Kitty by her former husband that is to say making the last four children equal heirs to my Estate remaining in this last item.

In testimony whereof I have hereunto set my hand, mark, and seal this 29th day of August 1874.

The foregoing last will and testament of Austin Oliver decd. was produced to court and proved to be the act and deed of the said Austin Oliver decd. by the oaths of John H. Frost, J.S. Kittinger, and Ben Plain the three subscribing witnesses thereto and the same is ordered to record which is now done accordingly.
