Know all men by these presents that W.W. Whitmer being feeble & in declining health but of sound and disposing mind and memory, calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing how the estate with which it has pleased God to bless me shall be disposed of after my decease while I have strength and capacity so to do. Do make and publish this my last will and testament revoking all others. And first I commend my immortal being to him who gave it and my body to the earth to be buried. And as to my worldly estate and all the property personal and mixed I devise bequeath and dispose of in the manner following towit:
Item, I give devise and bequeath to my beloved wife Elizabeth Ann Whitmer one third part of all both of my land and personal property to have and to hold [during] her natural life or her widowhood.
Item, I give and bequeath to my four oldest sons Joseph S. Whitmer & John B. Whitmer & Thomas L. Whitmer & Robert V. Whitmer & the above named sons are to pay all my just debts & burying expenses & after all my debts are paid they are to have my tract of land of which I possess & of which is to be divided equally betwixt the four, of which the four above named sons [are] to pay to my oldest daughter Mary Frances Whitmer fifty dollars & to my second daughter Msey [sic] W. Whitmer two dollars & to my third daughter Sarah Elizabeth Whitmer two dollars & to my forth daughter Ann Susan Whitmer two dollars & to my fifth daughter Debtha Jane Whitmer two dollars & to my sixth daughter Hanna Leurana Whitmer two dollars & to my youngest & last child Issac Whitmer two dollars all of which is to be paid by the above named sons & if my beloved wife marries again my four oldest sons is to have her third of the land and property.
In testimony whereof I the said William W. Whitmer to this my last will and testament contained on one sheet of paper & to this sheet of paper subscribed my name and affixt my seal this the fifteenth day of May 1862, in the year of our Lord one thousand & eight hundred & sixty two.

The foregoing last will and testament of William W. Whitmer, deceased, was exhibited into court on the date aforesaid, and fully proven to be the act and deed of said decedent by the oaths of Joseph P. Hendricks, Peter Shaver & Daniel J. Gish, subscribing witnessees thereto, thereupon the same was ordered to be recorded & the same hath been truly recorded in my office, this 7th day of July 1862
