Zilman Wood Will

Transcription

I, Zilman Wood, of the county of Muhlenberg and state of Kentucky, do make this my last will and testament, that is to say.

1st, I give to my son James W. Wood one bay horse five years [old[, a saddle and bridle.

2nd, I give to my beloved wife Mary Ann Wood all my estate, both real, personal and mixed, to be held and used by her as she may desire or may think proper and I hereby authorize her to sell my negroes or either of them or hire them out if she chooses so to do and to sell my land or any part thereof and to deed and convey the same if she desires so to do and to sell any other property that I may leave in her hands, and to enjoy the proceeds, [to] her and my family during her lifetime, then I desire that whatever of my estate may remain should be equally divided among my children or their heirs if any.

3rd, I do hereby constitute and appoint my wife Mary Ann Wood executrix of this my last will and testament and I desire and direct that the court should not require her to give bond or security but then my will should be recorded and so remain.

In witness whereof I have hereunto set my name and affixed my seal this 11th July 1859.

There being one thing forgotten when I made this will, that is, I wish my wife Mary Ann Wood to hold all my property as the will states during her widowhood but provided she marries again, I then want my property all sold and divided among the heirs of my body. Only her portion that the law sets aside for her.

I, Jesse H. Reno, clerk of the County Court, do certify that the foregoing will of Zilman Wood was produced into Court and proven to be the last will and testament of Zilman Wood decd. by the oaths of James Taggaret, Abner Wood & Jefferson Hunt, subscribing witnesses thereo, which was ordered to and which is truly recorded. Witness my hand as clerk of said Court.
